MURPHY EXPEDITIONS PARTICIPANT AGREEMENT, RELEASE AND ASSUMPTION OF RISK In consideration of the services of Murphy Expeditions LLC, its agents, owners, officers, volunteers, employees, and all other persons or entities acting in any capacity on their behalf (hereinafter collectively referred to as "Murphy Expeditions"), I hereby forever and irrevocably release, waive, indemnify, covenant not to sue and hold harmless Murphy Expeditions from and against any and all claims, causes of action, demands, damages, liabilities, losses, costs and expenses (including reasonable attorneys’ fees) relating to or arising out of my participation in expedition-related events, including, but not limited to, claims arising under contract, any claims for personal injury, temporary or permanent disability, death and/or property damage, howsoever caused or arising whether by negligence or otherwise, the fullest extent permitted by law. I acknowledge and agree that an expedition carries with it an inherent risk associated with my participation therein, of which I am fully aware, and voluntarily assume the risks associated therewith. I recognize and acknowledge that by participating in an expedition, I may experience potential property damage, health risks and/or bodily injuries, including but not limited to death, and voluntarily assume those risks, whether they occur or arise during or after my participation in the expedition. In the event of an emergency, accident or illness resulting from my participation in an expedition, I hereby give permission to be treated by professional medical and/or emergency response personnel and to be transported and admitted to a medical facility, if necessary. I consent to any emergency procedure or treatment, which may, in the opinion of any medical or emergency response provider, be necessary to treat my health condition or injury, including medical transportation by ambulance, helicopter or other means. I further assume responsibility, financial or otherwise, for any and all emergency medical care and transportation from the expedition by ambulance, helicopter or otherwise, and indemnify and hold harmless Murphy Expeditions from all liability therefor. I hereby acknowledge that Murphy Expeditions and all other parties involved in an expedition are under no obligation to provide medical care to me in the event of an accident or illness. Therefore, in the event I do receive any care, medical or otherwise, as a result of a health or medical emergency during my participation, I hereby consent to such care and fully release, indemnify and hold harmless Murphy Expeditions and all other parties involved in the expedition providing such care from any and all liability, whether resulting from negligence or otherwise, to the fullest extent permitted by law. I will defend, indemnify, hold harmless and reimburse Murphy Expeditions from and for all damages, losses, costs, or expenses (including attorneys’ fees) incurred by Murphy Expeditions or paid by them to any person (including me or my insurers) in respect of any accident, injury (including death), loss, or property damage, however caused resulting from, arising out of, or otherwise in connection with my participation in the expedition. I hereby expressly waive and release any and all claims which I may have, whether known or unknown, against Murphy Expeditions arising out of or attributable to my participation in the expedition, including any claims in connection with the COVID-19 pandemic or any other communicable disease. This includes claims relating to Murphy Expeditions’ negligence, or any claims against Murphy Expeditions for libel, slander, right of publicity, defamation, trademark infringement, or copyright infringement. I agree I am not entitled to any consequential, indirect, incidental, exemplary, special, reputational, or punitive damages arising from or related to the expedition or Murphy Expeditions’ conduct. I covenant not to make or bring any such claim against Murphy Expeditions, and forever release and discharge Murphy Expeditions from liability under such claims. I agree and acknowledge that this Release is intended to be as broad and inclusive as permitted by the law of the State of Washington, and that if any part of the Release is held invalid such holding shall not operate to invalidate any other provision of this Release not held invalid. I agree that this Release shall be governed by the substantive law of the State of Washington and the exclusive jurisdiction and forum for any claim for injuries or damages resulting from my participation in any of the Murphy Expeditions events shall be in the state and federal courts of competent jurisdiction located in the State of Washington. I HEREBY ACKNOWLEDGE AND AGREE THAT BY SIGNING THIS RELEASE, I HAVE READ AND UNDERSTAND ALL THE TERMS CONTAINED HEREIN AND AM GIVING UP SUBSTANTIAL LEGAL RIGHTS THAT I OTHERWISE HAVE FOR INJURIES OR DAMAGES INCURRED DURING AND AFTER MY PARTICIPATION IN THE EXPEDITION. I FURTHER UNDERSTAND AND ACKNOWLEDGE THAT THE TERMS OF THIS RELEASE SHALL SURVIVE THE CONCLUSION OF THE EXPEDITION SUCH THAT I AM RELEASING MURPHY EXPEDITIONS FROM ALL CLAIMS THAT MIGHT ARISE AFTER THE EVENTS TAKE PLACE, WHETHER KNOWN OR UNKNOWN AT THE TIME I PARTICIPATED IN THE EXPEDITION.
